Barangay Tamarok, Jose Dalman, Zamboanga del Norte “ even Barangay Officials and two civilians here are facing both criminal and administrative charges at the office of the Ombudsman Mindanao in Davao City”.
The charges stemmed from the complaint of the first Barangay Councilor Felomino Ango against the nine accused for Falsification of Public Documents by public officers under Article 171 paragraph 2 of the Revised Penal Code.
The alleged falsified documents were the resolutions of Barangay Council of Tamarok and the joint resolution of Barangay and the Tribal Council of said Barangay supporting the planned mining exploration activities of TVI Resource Development Philippines here.
In an affidavit, First Barangay Councilor Felomino Ango alleged that such resolution was falsified since there was no session on May 19 this year. Two witnesses affirmed the allegation of Barangay Councillor Ango.
He said, during that time, he went to the “taboan” or barangay market place, as it was a market day and the day for their regular session.
The Barangay Hall where the session is held is near the market place, so every now and then he goes to the Barangay Hall to find out if there was going to be a session, Councilor Ango said.
“That one time at about ten in the morning, Barangay Captain Lorido Timonio came to the market place but left immediately and I stayed in the market place until 5:30 in the afternoon and there was no session”, Ango’s affidavit narrates.
Sometime thereafter he said, he went to the Barangay Secretary Posito Dumolon together with Virgilio Gondola and Pepito Ango to find out if there was a session on May 19, but he answered that if he will not be involved he will tell me that there was really no session.
“I was able to obtain the signatures of Barangay Councilors Dionilo Tigon, Melchor Atam, Jolito Ito, Emerencio Eguia and they manifested that there was no session on May 19″, affidavit explains.
The signatures also manifested that there was no Joint Session between the Barangay Council and the Tribal Council of Tamarok as reported. In fact Barangay Captain Lorido Timonio was not present because he brought the son of the barangay Tribal Council Dominador Tigon to Manukan the adjacent town of Jose Dalman for treatment affidavit stated.
The affidavit added that Dionilo Tigon was in Laag, Sindangan and was not also present, and this has caused the filing of the case to the ombudsman for falsification of public document by the public officer.
In the year 2002, TVI was alleged to have obtained barangay resolution in Barangay Tabayo, Siocon Zamboanga del Norte supporting its mining exploration without the benefit of a proper session, the record shows.
